Draft Letter To Sambra Members

Dear Valued SAMBRA Member,

Following the communication from the RMI Board of Directors of 3 July 2012, in terms of which members were given the re-assurance that the interests of motor vehicle body repairers is a key priority and aligns fully with the RMI’s overall objective to improve the trading conditions for its members, the following question has been raised by numerous interested SAMBRA members, namely who has legitimate claim to the name and intellectual property of SAMBRA.

For the record, we wish to make it emphatically clear that the RMI is the ultimate custodian of its various constituent associations, including that of SAMBRA. In terms of its Constitution, the RMI holds the sole and exclusive rights to the names and all intellectual properties of the constituent associations.

The name, South African Motor Body Repairers’ Association; the abbreviation, SAMBRA and the logo thereof are registered as trademarks of the RMI with the Trade Marks Office in terms of the relevant legislation. The RMI views any infringement with its registered trademarks in a very serious light and such infringement will be dealt with according to the Trade Marks Act 194 of 1993 and/or other possible remedies available to the RMI in the relevant forum.

There should be no doubt that the only legitimate South African Motor Body Repairers’ Association (SAMBRA) is the structure that is part of the RMI.

The RMI via its constitute association SAMBRA will as in the past continue to render both labour and trade benefits and services to members, whilst continuing to build effective and beneficial relationships with other stakeholders such as insurance companies, OEM’s, Government, etc. for the betterment of business within the motor vehicle body repair environment.

We wish to also take this opportunity to once again reassure members that the RMI / SAMBRA is totally focused and committed to addressing the needs of its members and rely on your continued involvement and support in RMI and SAMBRA related activities to ensure that we are successful in attaining your and our industries’ collective objectives.

    Firstly, SAMBRA is a member driven organisation and therefore belongs to the members, not the RMI. Without the members, there is no SAMBRA.

    Secondly, you are bombarding members with emails “setting the record straight”, but why are you unable to give members answers to simple questions like:

    1) What is the RMI’s reasons for refusing the requests and demands of SAMBRA members?
    2) Why did you fire Aleeshen Kisten as SAMBRA National Director, who has contributed more to the motor body repair industry than the RMI has ever been able to?
